Welcome to PointPe! These Terms & Conditions ("Terms") govern your access to and use of our services, including the PointPe mobile application, website, and all related services (collectively referred to as the "Services"). By using our Services, you agree to comply with these Terms, which apply to both customers (individuals who book rides) and drivers/PointPe partners/vehicle owners (individuals who offer their vehicles to provide rides).
If you do not agree with any part of these Terms, please refrain from using our platform.
General Terms
Eligibility
You must be of legal age in your jurisdiction (18 years or older) and have the capacity to enter into legally binding agreements in order to use our Services.
Account Creation and Maintenance
To use PointPe’s Services, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and all activities under your account. Please notify us immediately if you suspect any unauthorized use of your account.
Service Availability
PointPe strives to provide uninterrupted services but does not guarantee continuous, error-free access. Service interruptions may occur due to maintenance, technical issues, or other unforeseen circumstances.
Use of Service
You agree to use our Services only for lawful purposes and in accordance with these Terms. You may not use our platform in any way that could harm, disrupt, or damage the Services, violate any applicable laws, or infringe upon the rights of others.
Changes to Terms
PointPe reserves the right to modify, update, or revise these Terms at any time. Any changes will be communicated to users through the platform or email. By continuing to use the Services after updates, you agree to the revised Terms.
Customer Terms (Riders/Passengers)
Booking a Ride
Customers (riders/passengers) can use the PointPe platform to request rides. By booking a ride, you agree to the fare structure and any applicable taxes or fees. All bookings are subject to vehicle availability, driver acceptance, and applicable laws.
Payment
Payments for rides must be made using the payment methods available in the app / pointpe.in's website, either partial or full payment. You are responsible for ensuring that your payment method is valid and up to date. PointPe reserves the right to charge additional fees for late payments or cancellations as specified in the app.
Ride / Booking Cancellations
Cancellations made by customers may be subject to a cancellation fee as outlined in the app. If a customer cancels a ride after the driver has been assigned, the cancellation fee will be determined based on the location, timing, and type of ride.
Conduct During the Ride
You agree to behave respectfully and responsibly during the ride. Any disruptive behavior, including abusive language, damage to the vehicle, or violation of laws, may result in the cancellation of the ride and reporting to local authorities if necessary.
Safety and Security
PointPe takes safety seriously. You agree to follow all safety guidelines set by PointPe, including using seat belts, adhering to local traffic laws, and ensuring that your actions do not jeopardize the safety of yourself, the driver, or other passengers.
Driver/PointPe Partner/Vehicle Owner Terms
Eligibility to Drive
To be a driver or PointPe partner, you must meet the following criteria:
- Be at least 21 years old.
- Hold a valid driver’s license.
- Have a registered vehicle that meets PointPe’s standards.
- Complete and pass a background check and any other screening procedures required by PointPe.
Ride Acceptance and Completion
Drivers/partners must accept or reject ride requests based on availability. Once a ride is accepted, the driver must complete the ride to the designated destination. Drivers are expected to follow all traffic laws, provide excellent customer service, and ensure the safety and comfort of the passenger.
Earnings and Payment
Drivers will receive payment for completed rides based on the fare structure determined by PointPe. Payments are processed daily during Pessenger's Pick-Up & Drop, and any fees or commissions will be deducted accordingly. PointPe reserves the right to modify the earnings structure and commissions from time to time.
Vehicle Ownership and Maintenance
As a vehicle owner, you are responsible for the maintenance, repair, and upkeep of your vehicle. You must ensure that your vehicle remains roadworthy, insured, and compliant with local regulations. PointPe is not responsible for the costs associated with vehicle maintenance or repairs.
Conduct and Ratings
Drivers are expected to behave professionally and respectfully toward riders at all times. PointPe uses a two-way rating system where both drivers and customers can rate each other after a ride. Negative feedback or repeated violations may result in suspension or termination of your account.
License and Compliance
Drivers/partners must hold the necessary licenses to operate a vehicle for commercial use in their respective jurisdictions. You agree to comply with all local laws and regulations, including tax obligations and insurance requirements. PointPe will not be liable for any violations of such laws.
Data and Privacy
Data Collection
PointPe collects and processes personal data as outlined in our Privacy Policy. By using our platform, you consent to the collection and use of your data in accordance with the policy.
Data Sharing
PointPe may share your personal information with third-party service providers, such as payment processors or background check companies, for the purpose of providing our Services. We do not sell or share your personal data with third parties for marketing purposes.
Confidentiality
Both customers and drivers agree to keep any confidential information shared during the course of using the platform private and not disclose it to unauthorized third parties. Payments are processed daily during Pessenger's Pick-Up & Drop, and any fees or commissions will be deducted accordingly. PointPe reserves the right to modify the earnings structure and commissions from time to time.
Dispute Resolution
In case of any disputes between PointPe, customers, or drivers, we encourage resolving issues amicably through our customer support team. If a resolution is not possible, the dispute will be settled through arbitration or mediation as outlined in our legal agreements.
Indemnification
You agree to indemnify and hold PointPe, its affiliates, partners, officers, employees, and agents harmless from any claims, damages, losses, or liabilities arising from your use of the Services or any violation of these Terms and Conditions.
Limitation of Liability
PointPe is not liable for any indirect, incidental, or consequential damages arising from the use of the platform, including but not limited to damages resulting from ride cancellations, delays, vehicle breakdowns, or accidents. Our liability is limited to the maximum extent permitted by law.
