Customer Agreement

This Customer Agreement (“Agreement”) is entered into by and between InfoTheme Private Limited, a company incorporated under the laws of ROC Dehradun, Uttarakhand, India, with its principal place of business at [KH No.747, Dandi Nehru Gram P.O. Nehru Gram , DEHRADUN, Uttarakhand, India - 248001.], (hereinafter referred to as “Company” or “InfoTheme”), and the Customer (hereinafter referred to as “you” or “your”).

The brand PointPe operates under InfoTheme Private Limited. By using or accessing the services provided by PointPe (the “Platform”), including booking rides, making payments, and other related activities through the PointPe platform (the “Services”), you agree to comply with and be bound by the terms of this Agreement. If you do not agree to these terms, you must not use the Services.

Definitions

We collect various types of data to provide you with the best possible service. This data includes:

  • Customer

    A person who uses the services provided by PointPe to book a ride.

  • Platform

    The online platform provided by PointPe, accessible through its website or mobile application, through which rides are booked.

  • Fare

    The total charge for the ride, including base fare, taxes, platform fees, and any additional charges applicable.

  • Platform Fee

    A fee charged by PointPe for providing the online platform and facilitating the booking, payment, and coordination of the ride.

  • Commission

    The platform fee charged by PointPe to vendors for each booking made through the Platform.

Services Provided

All data is processed to ensure smooth operations, as follows:

  • PointPe offers an online platform to facilitate the booking of cab rides by customers. The platform enables customers to connect with third-party vendors (drivers and vehicle owners) to book rides at public fare rates. The fares are set by the respective vendors, subject to availability and demand.

  • PointPe does not own or operate the vehicles nor does it provide transportation services. The vendors (drivers/vehicle owners) are independent contractors, and any agreements made regarding ride services are directly between the customer and the vendor.

Charges and Fees

Here are information about charges, fee & taxes

Platform Fees:

  • 5% Commission

    PointPe charges a 5% commission on the total fare from the vendor side for each booking made through the Platform. This commission is charged as a platform service fee.

  • 2% Platform Fee

    A 2% platform fee will be charged to customers for using the PointPe platform to facilitate booking and payment processing. This fee is applied on top of the ride fare and any additional charges.

Taxes:

  • 5% Tax (GST)

    In addition to the platform fees, PointPe will charge a 5% tax on the total platform fee charges. This tax is collected from the customer and will be included in the final fare charged.

Payment Processing

  • How we process payment

    All payments made through the PointPe platform for booking rides are processed through trusted third-party payment gateways, such as CashFree Payments Network. PointPe is not responsible for any issues or errors arising during payment processing.

Booking and Ride Terms

  • Booking Process

    Customers can book a ride through the PointPe platform by selecting the desired pickup and drop-off locations, along with the vehicle type, and confirming the booking.

  • Cancellation Policy

    Cancellations may be made by customers through the platform, subject to the terms outlined in the PointPe Cancellation Policy. Cancellations may incur a fee, depending on the time and nature of the cancellation.

  • Ride Availability

    The availability of rides depends on the vendors (drivers/vehicle owners) in the area. PointPe does not guarantee that a ride will always be available.

  • Customer Obligations

    You agree to use the platform only for lawful purposes, and not to engage in any activity that may interfere with the proper functioning of the Platform or violate any laws or regulations.

KYC and Identity Verification

  • Driver and Vendor Verification

    To ensure safety and security, PointPe requires all vendors (drivers/vehicle owners) to complete a Know Your Customer (KYC) process. This process includes identity verification, vehicle registration, driving license verification, and bank account details.

  • Customer Verification

    In some cases, customers may be required to provide identity verification for booking purposes (e.g., Aadhar verification for identity verification), especially for high-value transactions or safety reasons. The KYC process for customers is performed through trusted third-party networks like API Setu and CashFree Payments Network.

Location Data

  • Collection of Location Data

    PointPe collects location data for the purposes of tracking your pickup location during ride search and live tracking during an ongoing ride. This data is only used for the duration of the ride and is shared with the vendor for efficient ride management.

  • Tracking and Safety

    To ensure customer safety, PointPe provides real-time tracking of the ongoing ride, which can be shared with family members or relatives. The tracking data is transmitted through a secure, encrypted link.

Data Security and Privacy

  • Data Protection

    PointPe takes extensive measures to protect the data you provide, using encryption and secure storage systems. We do not store sensitive financial data, as all payment transactions are processed through CashFree Payments Network

  • Data Deletion

    If you choose to delete your account, PointPe will remove all personal / payment related data from our servers and send a deletion request to third-party services to ensure that your data / data request token is deleted from their systems as well.

Limitation of Liability

  • Platform Liability

    PointPe acts as a facilitator for ride bookings and does not provide transportation services. We are not liable for any damages, losses, or injury caused during your ride. Any disputes arising from the transportation service itself should be resolved directly between the customer and the vendor.

  • Platform Availability

    PointPe does not guarantee uninterrupted service availability. We will not be liable for any service downtime due to technical issues, server maintenance, or unforeseen circumstances.

Indemnity

  • Customer Indemnificatio

    You agree to indemnify and hold harmless PointPe, its employees, directors, and partners, from any claims, liabilities, damages, or expenses arising from your use of the Platform, including any violations of this Agreement or applicable laws.

Governing Law and Dispute Resolution

  • Governing Law

    This Agreement shall be governed by and construed in accordance with the laws of the nation India.

  • Dispute Resolution

    Any dispute or claim arising from this Agreement will be resolved through arbitration in accordance with the rules of the Indian Council of Arbitration (ICA). If the dispute cannot be resolved through arbitration, it shall be submitted for mediation under the rules of the Mediation and Conciliation Project Committee (MCPC).

Miscellaneous

  • Amendments

    PointPe reserves the right to amend or modify this Agreement at any time. Any changes will be posted on the website or app, and the updated Agreement will be effective as of the date indicated.

  • Severability

    If any part of this Agreement is found to be invalid or unenforceable, the remaining provisions will continue to be in full force and effect.
